1. Introduction
Welcome to UBC - IT Consulting & Software Development UG (haftungsbeschränkt) (“Company”, “we”, “our”, or “us”). These Terms of Service (“Terms”) govern your access to and use of our Microsoft Teams application (“App”), including any content, features, and services made available through it. By installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
2. Eligibility
You may use the App only if you are:
• At least 18 years old (or the legal age of majority in your jurisdiction).
• Authorized by your organization or Microsoft account to install and use third-party applications.
3. Use of the App
• You may use the App solely for lawful purposes and in accordance with these Terms.
• You are responsible for maintaining the confidentiality of your Microsoft account credentials and any activity under your account.
• You agree not to misuse the App, including but not limited to:
• Reverse engineering, modifying, or creating derivative works.
• Using the App to transmit harmful, illegal, or infringing content.
• Attempting to disrupt or compromise the security of our systems or Microsoft Teams.
4. Privacy
Your use of the App is also governed by our Privacy Policy. By using the App, you consent to the collection and use of information as described in the Privacy Policy.
5. Intellectual Property
All rights, title, and interest in and to the App (excluding Microsoft trademarks, logos, and services) remain the exclusive property of UBC - IT Consulting & Software Development UG (haftungsbeschränkt). You are granted a limited, non-exclusive, non-transferable license to use the App in accordance with these Terms.
6. Third-Party Services
The App integrates with Microsoft Teams and may interact with other Microsoft or third-party services. We are not responsible for the availability, accuracy, or performance of third-party services. Use of such services is subject to their own terms and policies.
7. Disclaimer of Warranties
The App is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
8. Limitation of Liability
To the maximum extent permitted by law, UBC - IT Consulting & Software Development UG (haftungsbeschränkt) and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, or data arising out of or related to your use of the App.
9. Indemnification
You agree to indemnify, defend, and hold harmless UBC - IT Consulting & Software Development UG (haftungsbeschränkt), its officers, employees, and affiliates from any claims, liabilities, damages, losses, or expenses (including legal fees) arising out of your misuse of the App or violation of these Terms.
10. Termination
We may suspend or terminate your access to the App at any time, without notice, if you violate these Terms or if we discontinue the App. Upon termination, your right to use the App will cease immediately.
11. Governing Law and Jurisdiction
These Terms shall be governed by and construed under the laws of Germany. Any disputes shall be subject to the exclusive jurisdiction of the courts located in Hamburg, Germany.
12. Changes to Terms
We may update these Terms from time to time. The updated version will be posted on our website with a revised “Last Updated” date. Your continued use of the App after changes are posted constitutes acceptance of the updated Terms.
